Truth or Liability?
At the AAN Annual Meeting, TNP Puts Attendees’ Knowledge of Liability Issues to the Test

The challenge to contestants was clear: Can you spot the truth? At the 2010 Annual Meeting of the American Academy of Neurology, contestants rose to the challenge posed by the interactive game show, “Neurology: Truth or Liability?” Neurologists, practice managers, residents and AAN staff participated in the three shows hosted by PRMS, the manager of The  Neurologists'  Program, on the Academy Central stage at the Toronto meeting on April 12 and 13, 2010.

The moderator of the game show posed questions relating to liability risks and insurance matters to a panel of highly trained risk managers and claims experts. Three  panelists  answered, and two of them blatantly lied with the straightest of faces and most convincing of replies. The contestants' mission? To identify the true answer over the liability risks. The PRMS risk managers did not make this an easy task. Tempted, however, by the lure of fame, applause, and a free TNP chocolate bar, contestants agreed to put their knowledge to the test.

Many topics were fair game: off-label prescribing, medical malpractice claims, the use of technology in neurology practices, just to name a few. Contestants could elicit advice and opinions from the audience (but could not, however,  "phone a friend"). The game show allowed the audience to discuss and dissect liability issues and trends with each other and with experts. The PRMS staff transformed serious issues into a comfortable and collaborative conversation with AAN meeting attendees. In the end, the contestants and audience walked away with a better understanding of emerging liability trends in the field of neurology.

Truth or Liability?

What percentage of medical malpractice claims filed against doctors of all specialties results in money being paid to the person filing the lawsuit?

Answer 1:  Almost 90%. Doctors are so afraid of losing their assets to these runaway jury verdicts that they demand their insurance carriers pay huge amounts to get rid of even the most ridiculous claims.

Answer 2:  About 20%, and most of these payments are the result of a settlement rather than a jury verdict.

Answer 3:  Less than 1%. The media focuses on these ridiculous jury verdicts, but the truth is that the overwhelming percentage of all money paid out by malpractice insurance companies goes to defense lawyers. Patients very rarely get anything.
